1. The definition
The following terms have the following meanings:
EES Vital: the private company EES Vital.
Client: any natural or legal person with whom a contract has been concluded.
Products/Services: all items that the client can purchase from EES Vital, including Energy Enhancement System sessions.
2. Applicability
These General Terms and Conditions apply to all offers, estimates, orders and purchases of products/services between EES Vital and the client.

EES Vital reserves the right to modify these Terms and Conditions at any time by publishing a new version on the aforementioned website. Any order placed by the Client after EES Vital has published this new version will imply the Client’s acceptance of the last published version.
If EES Vital has expressly or tacitly permitted any deviation from these General Terms and Conditions for a short or longer period, this shall not affect its right to require strict compliance with these General Terms and Conditions at any time.
3. Offers and prices
If an offer or other offer from EES Vital has a limited period of validity or is subject to conditions, this will be expressly mentioned.
The offer or any other offer from EES Vital contains sufficient information to enable the client to understand the rights and obligations associated with its acceptance.
Unless expressly stated otherwise, the prices for products/services communicated and/or published by EES Vital are always in euros and include VAT. Reservations for services will be invoiced according to the prices and conditions in effect at the time of the order/reservation acceptance.
EES Vital is not bound by obviously incorrect pricing information, such as printing or typing errors. The client cannot derive any rights from illegal pricing information.
EES Vital reserves the right to adjust the prices of products/services.
If payment is made in cash, the client cannot claim a discount.
4. Payment
The client is solely responsible for the order and payment. If the order is placed by a third party, it is deemed to be placed in the client’s name and on behalf of the client.
The client’s payment to EES Vital for the purchase of one or more products/services is processed as follows: When booking online, the client can choose whether to pay directly online or on-site. When booking by phone or email, the payment terms are agreed upon in advance either by bank transfer or directly on-site. The total amount must be paid by the client shortly before the start of the appointment at the latest. This can be paid in cash on-site or in advance online using several electronic payment options. If the client is unable to pay for the session upon arrival, they may be denied access.
Invoices can be issued upon request and are due 21 calendar days after the invoice date or on the day of the activity (whichever occurs first). In case of late payment, the debtor will automatically and without prior notice be charged interest at a rate of 2% per month, plus an administrative fee of EUR 20.
5. Cancellation and modification of a reservation
If a cancellation (by either the client or EES Vital) occurs less than 1 day (24 hours) before the start of the session, a 100% refund of the amount paid will be issued. The refund will be made through the same provider through which the original payment was made, unless otherwise agreed with the client.
For cancellations within 24 hours of the start of the session, only 50% of the paid amount will be refunded. The refund will be made through the same provider used for the original payment, unless otherwise agreed with the client. If the amount due for the reservation has not yet been paid, the same rules apply: the amount must be paid accordingly.
If EES Vital cancels your booking for any reason, you are entitled to a full refund of the amount already paid or you can choose to rebook free of charge. You are not entitled to compensation for any costs incurred as a result of the cancellation by EES Vital (e.g., travel expenses).
If you would like to change your booking (time, date, number of people), you can do so free of charge up to 1 day (24 hours) before the start of the booking. All changes are only final upon receipt of written confirmation from us. Changes are subject to availability and can be made via email or online.
If you wish to change your reservation within 24 hours of the start date, you must do so by calling the number provided at www.ees-vital.com/contact. An administration fee of EUR 20 will be charged. Changes are subject to availability.
6. Validity and use of subscriptions/packages
Purchased subscriptions/packages are valid for one year from the date of purchase and are personal and non-transferable.
Packages once purchased are final and non-refundable.
Our subscriptions remain fully valid even if we relocate.
There is no right to a refund or early termination due to the relocation.
By using the subscription at the new location, our customers expressly acknowledge the continued validity of the existing contractual terms and conditions. The continuation of subscriptions at the new location is subject to the opening hours and service conditions applicable at that location, which may differ from the previous conditions.
7. Regulations during your visit
EES Vital adheres to a fixed schedule. If you arrive later than the agreed time, you can still attend the session, but the session will not end at a later time. The length of your stay will be shortened accordingly. In this case, you are not entitled to a (partial) refund of any kind.
During your session, please use our recliners. Blankets and pillows are provided in our rooms.
Eating in the EES room is not permitted, but you can have a snack in the designated reception area.
Drinking water is available in the rooms and is free of charge. All other beverages must be consumed in the reception area and not in the EES room. Filling and taking away drinking water after the session is not permitted.
You may leave the rooms during the session to use the restroom.
The use of mobile phones or iPads in airplane mode is permitted as long as they don’t make any noise. We recommend leaving your phone outside or in your bag.
We ask that you refrain from speaking or whispering in the EES room. Please try to be as quiet as possible at all times to avoid disturbing others and allow them to relax.
The EE system must not be touched under any circumstances. Please leave your luggage in the vestibule or entrance area. The installation is carefully aligned to provide an optimal experience. Failure to comply with this rule may result in your being denied access to the session.
EES Vital is accessible for standard wheelchairs. If you book a session with us and arrive with a wheelchair, please inform us in advance via mail@ees-vital.com. We would like to know all measurements and any additional assistance you may need so we can assist you as best as possible. You are welcome to attend the session in your own wheelchair.
8. Liability
EES Vital does not offer medical advice or diagnoses, and our sessions cannot be considered medical treatment. For medical advice, consult your physician or other professional healthcare provider. Clients are encouraged to promptly report any medical questions, complaints, or symptoms to their physician or other healthcare professional for a professional examination, diagnosis, and, if necessary, medical care. Clients are advised never to delay seeking professional care or to disregard previously obtained medical advice based on the information on our website.
EES Vital cannot be held liable for any damage to persons, goods (including the products), animals, services, etc. resulting directly or indirectly from our products/services, except in cases of fraud or deception.
9. Data protection
Personal data collected by EES Vital will only be used for the purpose clearly described in the software or to contact you to provide the best possible service. We do not share or sell this information with third parties. You have the right to access, change, or delete this data.
Your data is stored only digitally.
10. Applicable law and place of jurisdiction
The contractual relationship between EES Vital and the client is governed exclusively by Swiss law. All disputes are subject to the exclusive jurisdiction of the courts of the Urtenen-Schönbühl judicial district.
